Legal Notice-City of Whiteville Purchase Certain Real Property Pursuant To N.C.G.S 160A-269
The Whiteville City Council met on Tuesday, October 23, 2018 and authorized the City Manager to dispose of certain real property (“property”) by negotiated offer, advertisement, and upset bid pursuant to NCGS 160A-269. The property is described as being a portion of Tax Property Number 60602, proposed as approximately 3.7 acres in Deed Book 1095 at Page 633. A copy of the plat of the property can be viewed at the City Clerk’s office.
The City has received an offer to purchase for the sum of $40,000 for the property described above, in addition, land-clearing services on approximately 3 acres. The entity making the offer has deposited with the City Clerk a sum equal to five percent (5%) of the offer in the form of a certified check.
The Whiteville City Council proposes to accept the offer unless a qualifying upset bid is made. Persons or entities wishing to upset the offer must submit an upset bid to the City Clerk within ten (10) days after publication in The News Reporter newspaper of this notice through 5:00 p.m. on Thursday, November 15, 2018. The upset bid must be not less than ten percent (10%) of the first one-thousand dollars and five percent (5%) of the remainder.
The person making the upset bid must deposit with the City Clerk, a sum equal to five percent (5%) of their offer in the form of a certified check. If a qualifying upset bid is received, the City Clerk has been directed to re-advertise the offer at the increased upset bid amount, and to continue with this process until a ten (10) day period has passed without receipt of a qualifying upset bid.
